Cancellation of Permanent residence


Q1: What kind of circumstances shall the National Immigration Agency revoke or cancel a foreign professional's Permanent Resident Certificate?

A1: A foreign professional's permanent residence permit shall be revoked or cancelled by the National Immigration Agency if the person leave Taiwan and has never returned for 5 years or above. The provisions of Subparagraph 4, Paragraph 1, Article 33 of the Immigration Act shall not apply.


Q2: Would a foreign professional's spouse, minor children, or children over 20 years old who are unable to live independently due to physical or mental disability be affected if said person's permanent residence permit is revoked or cancelled?

A2: Where the permanent residence permit of a foreign professional is revoked or cancelled in accordance with the provisions of the Act for the Recruitment and Employment of Foreign Professionals or Article 33 of the Immigration Act as referred in the preceding regulation, the permanent residence permits of the spouse, minor children, or disabled children over 20, shall be revoked or cancelled together therewith.
